Just Comfort Shoes Visitation Service Terms and Conditions
These terms form part of the Just Comfort Shoes Terms and Conditions of Trade and Website Use.
The Just Comfort Shoes Visitation Service, involving the Home Visitation Program and the Village Visitation Program, is a schedule of visits to pre-determined locations on pre-determined days, allowing customers to try on and buy shoes at home on a pre-booked appointment basis. By seeking an appointment, customers agree to the following terms.
Shoe fitting appointments are free of charge, but a small fee applies in some circumstances.
Customers may express their interest before the booking deadline applicable to each visit date, let us know of one or more of their available times, and provide details of their feet and their footwear needs and interests by phone or by online form. When providing details by online form, customers may also optionally register for an online account with the scheduling calendar to access and modify their submitted details.
Customers are responsible for the accuracy of the information they provide. By using the service, customers warrant that the visitation programs' arrangements do not breach any rules or requirements applicable to the appointment location.
Customers who have submitted their details online may use the links shown on the last website page of the booking process or in the notification email they receive afterwards to change their time/s or cancel. Those who register for an online account with the scheduling calendar when booking can also use the "Log in" link at the top right of the "How to Book" area of the booking page make changes to their details. Customers who book by phone or who otherwise need help may phone on 0432 307 672 to make changes.
Changes and cancellations to booking are free if made before bookings close for the itinerary date concerned. A fee of $5.50 applies either at checkout during the visit or by invoice for non-attendance or if, after bookings close, customers change their available time/s or cancel. If it is an invoiced fee, it will need to be paid before any future appointments are confirmed for the customer.
Appointments that Just Comfort Shoes is unable to attend or chooses not to attend because the customer-provided appointment location is inaccurate, or fails to have parking available within 30m, or is not a ground-floor or lift-accessible residence located within the suburbs shown on the itinerary for the visit date, will incur the cancellation fee of $5.50 unless conditions match alternative arrangements we have agreed to.
Visits and appointments are subject to minimum booking numbers that may vary from time to time. They are also subject to our perception of the viability of arrangements, and to other factors such as vehicle and personal access to the premises, access for goods, premises regulations for business visits, the availability of 3G data to operate card payment facilities, traffic, weather and the availability and reliability of vehicles and equipment.
While we endeavour to provide the service as intended, we reserve the right to cancel itinerary dates and localities, available appointment times and confirmed appointments without notice for any reason and without compensation to customers. We do not guarantee that online scheduling software will work accurately, or that we will be able to confirm a booking, offer shoes for sale or shoes that suit preferences indicated or that suit a particular purpose or foot, or that we will attend an appointment, arrive in a timely manner, complete the appointment or complete a fitting if we need to leave. We do not guarantee customers the opportunity to browse styles on a mobile device or to have their feet measured, photographed or scanned for future reference while at an appointment.
Goods remain the property of Just Comfort Shoes until paid for in full. By using the service, customers agree to receive a handwritten or emailed receipt in the event that a printed receipt is not available.
The visitation programs cannot be used for customers to receive delivery of Special Orders. Special Orders need to be received in accordance with our Special Orders policy, which requires either in-store pickup or a freight cost for forwarding by mail.
The visitation programs cannot be used to return previously purchased shoes. Returns should follow the process described in our returns policy. Returns of shoes purchased during the visitation program may be returned in store or by mail using the process that applies to phone or online purchases.
The visitation programs cannot be used for Department of Veterans' Affairs Medical Grade Footwear fittings.
Just Comfort Shoes shall not be liable for any loss or damage that customers incur as a result of its non-performance of any intended function of the visitation programs. Customers may be liable for loss or damage that Just Comfort Shoes incurs as a result of any harmful act or omission by the customer, including the use of an unsafe location or premises, or inaccurate information about the premises, its condition or its rules.
Under no circumstances will Just Comfort Shoes be responsible for any loss or damage, including but not limited to personal injury or death, resulting from customers' use of visitation program information.
BY USING THE VISITATION PROGRAM, THE USER WARRANTS:
THAT JUST COMFORT SHOES SHALL NOT BE IN ANY WAY LIABLE TO THE USER OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING FOR LOSS OF MONEY, GOODWILL, REPUTATION OR DATA ARISING FROM THE USER’S USE OF THE SERVICE OR ITS RELATED WEBSITE FUNCTIONALITY;
THAT THE USER WILL NOT HOLD JUST COMFORT SHOES RESPONSIBLE FOR OTHER USERS’ ACTS OR OMISSIONS.
THE USER AGREES THAT JUST COMFORT SHOES CANNOT GUARANTEE CONTROL OVER THE PERFORMANCE OR ACCURACY OF THE ONLINE SCHEDULER, AUTOMATED SCHEDULER EMAILS, OTHER COMMUNICATIONS, OR THE ACCURACY OF INFORMATION CONTAINED ON THE WEBSITE CONCERNING THE VISITATION PROGRAM.
Should Just Comfort Shoes, in its sole discretion, determine that any party has breached these Terms, then nothing herein shall prevent or in any way restrict its right to pursue any of its legal and/or other remedies, including, without limitation, court action.
